Biography

I have been practicing for over thirty-five years. My practice is limited to specializing in issues concerning disability, estate, probate, long term care, nursing home, Veterans, Medicaid and special needs planning. I am the immediate past President/Chairman of the Board of Directors of the Alzheimer’s Association - Greater Michigan Chapter (after having served for the last 6 years) and member of the Association's executive committee and an Assembly Delegate to Alzheimer’s Association – National Chapter, Chicago, Illinois. I am also a Member of National Academy of Elder Law Attorneys and have been listed since 1991 in the Academy's Experience Registry. Further, I am a past Chair of the Governing Council of the Elder Law and Disability Rights Section of the State Bar of Michigan. I am also a Charter Member of the Academy of Special Needs Planners and Member of the Financial and Estate Planning Council of Metropolitan Detroit. I have been recognized as a "Superlawyer" for 2016 and every year since 2009, which designates that I am one of the top lawyers in my field. I am also an accredited attorney with the US Department of Veterans. I have also been selected in 2014 by Hour Detroit and Dbusiness Magazines as a 5 Star Wealth Manager in the area of estate planning and received the same award 2010 -2017. Q. What happens to my interest in my house if my husband passes away before co-owner?
A: Frankly there is not enough information to give you an answer. Are you on the deed with him at all? How does your husband and friends read - tenants in common or joint with rights of survivorship. Q. Hello, my Mother is 90 years old. She is in a long term care facility. She is unable to make decisions for herself.
A: I know dealing with your mother's health challenge especially under a pandemic. If your mother cannot make decisions for herself and there isn't a health care power of attorney, I am afraid you will need to become her guardian in probate court to make her care, custody, day to day, end of life and mental health decisions. There is one little know exception that is if your mother is currently on Medicaid. If she is not on Medicaid we can still save a good portion of her assets as well as her home, if applicable.

Q. My house is only in my late wife’s name. Can I put the house in my name without going through probate?
A: First my condolences on the loss of your wife. Unfortunately not. However, you can file an application for probate with or without a will. You will be appointed personal representative to manage your wife's affairs. if there are no objections or complications the probate should be relatively simple, inexpensive and not the horror stories you are probably thinking about.
