Biography

David Tapalian has lived in the Rhode Island and Massachusetts area his entire life. He is graduate of Brown University located in Providence, R.I. While at Brown, Mr. Tapalian earned his Bachelor’s Degree in Public Policy and American Institutions. Upon graduation from Brown University Mr. Tapalian then received his Juris Doctorate degree from the Roger Williams University School of Law. Immediately after graduation and passing the Bar Examination in Rhode Island, he then opened his own legal practice and has been at it ever since. He has also been admitted to the Massachusetts and Florida Bars as well as the Federal District Court for Massachusetts and Rhode Island. Mr. Tapalian areas of expertise are in personal injury/accident law. His focus is on vehicle accidents, slip and falls, falling objects, dog bites and pedestrian injuries.

Q. Is other vehicle's insurance responsible for car rental if they accepted fault for accident?
A: Every situation is fact intensive and related to that particular circumstance. However, when an insurance company accepts fault for an accident, they should be providing a rental, if one is needed. This is particularly applicable if they are paying for the repair of the vehicle. The situation changes somewhat when it's a total loss of the property damage. In that situation the obligation of the at fault insurance company is to provide a rental for a much shorter period of time; normally reasonably around the time when you receive the total loss payout. However, in this situation the other vehicles insurance should be responsible for your reasonable rental.
Q. I’m the passenger in a hit and run. What are my rights
A: You have a lot of rights. It really depends upon what your specific question is. Were you injured? If so, you would have the ability to go after those who are at fault for your injuries, including the driver and of course you could potentially use Florida PIP. If you present a more specific question, I'd be very happy to answer it as best as I can.

A: It’s always best practices to contact the police. Especially if this accident was not your fault, it’s always best to go through the other person’s auto insurance. I’ve seen time and again how handling it “private” backfires. If you are concerned you should file a police report.
