- The Fifth Amendment continues to be revisited. In this presentation, we will discuss the foundational principles of the Fifth Amendment in the age of iPhones. Our survey will begin in advance of development of the cell phone itself, and will end at the unsettled present. Topics will include a survey of caselaw discussing when and why the Fifth Amendment applies to various searches of smartphones, through facial and vocal recognition, finger and thumbprint production, and passcode production.
