Dan Miller was raised in Chesapeake, Virginia. He graduated from Norfolk Collegiate School in 1985, and graduated from Oxford College in 1987 with an Associate of Arts degree. Dan went on to graduate from Emory University in Atlanta in 1989 with a Bachelor of Arts degree, majoring in Philosophy and Sociology. From 1989 to 1995 Dan played drums in a band based in Atlanta Georgia where he toured the College Circuit throughout the Southeastern United States.
Dan graduated a semester early and was admitted to practice law in Virginia in November 1998. In 1998, Dan was hired by Michael I. Ashe where he laid his foundation focusing on Criminal and Traffic cases.
Dan is an active member of the Virginia State Bar, the Virginia Trial Lawyers, the Norfolk/Portsmouth Bar Association, the Virginia Beach Bar Association, the American Bar Association and the National Association of Criminal Defense Lawyers and is licensed to practice in all state and Federal Courts in Virginia.
In 2001, Dan founded Dan Miller and Associates. He currently resides in Virginia Beach with his wife Amy, daughter Hayden, and son Max. His firm is available 24/7.

- Q. If I have Primary custody of my daughter but share legal custody with every other weekend visitation with her mother
- A: It will depend on if there are any restrictions in the custody order. There does not appear to be any legal restrictions that would prevent this. Virginia Code § 22.1-4.3 provides that unless a court order specifies otherwise, non-custodial parents shall not be denied the opportunity to participate in any of the school’s activities and explicitly includes lunch breaks as being one such activity.
- Q. How do I amend my birthdate on my marriage certificate
- A: Virginia code § 20-16.1 authorizes the clerk or deputy clerk of a circuit court of any county or city to amend the record. The process will vary by county, for example Loudon county allows you to schedule an appointment with the clerk, whereas Fairfax county requires you to attend a court hearing before the license may be corrected.
- Q. Is gun prohibition in a New Jersey restraining order (civil case only) enforced in West Virginia? I'm moving there soon.
