An attorney for more than 19 years, Chris Walsh is an accomplished trial lawyer and has a broad range of specialized experience in the field of criminal law. As a prosecutor, Walsh was assigned the most serious cases in the offices where he worked. Walsh tried numerous sexual assaults, gang, driving under the influence, and homicide cases. He has personally tried more than 100 jury trials. Walsh was twice selected as Prosecutor of the Year. He is a member of Lawyers of Distinction in the area of Criminal Law, has been recognized as one of the Top 100 Trial Lawyers, and is a member of California DUI Lawyers Association.

- A: In this scenario, it will come down to whether or not the police actually had a valid basis to arrest you for the DUI in the first place. If the police had probable cause to believe you were under the influence of alcohol and/or drugs, then the arrest would be proper and the cocaine that was later discovered could be used against you.
What you would want to do in this situation is have a criminal defense attorney run a suppression motion on your behalf that challenges the reasonableness of your arrest for the DUI. A lot of folks do not realize that when you get a DUI, you have two battles you are facing, and potentially two DMV suspensions: one from the criminal side, and the other is the DMV side.
Because you prevailed on the DMV side you simply should focus on the requirements from your criminal case. While technically you are in violation of the terms of your probation by not enrolling within the time frame that the court specified, generally speaking, if you do enroll and get started within a reasonable time period you should be ok.
