Q. I have paid the mortgage for 7 years while my husband didn't contribute. Do I need to split the house 50/50 in divorce?
A: Hi there,

You ask an excellent question and you are wise to start looking for appropriate resources to help you have perspective as to what could happen in a divorce and what your legal rights are. The best answer I can give you without more information is "maybe." Domestic relations law in Colorado provides for an "equitable distribution" of property subject to division by the Court. There are many nuances, cases, and laws that boil this general idea down quite a bit further.

To point out one that may be of particular interest to you is the legal doctrine of "contribution." Sometimes when one spouse contributes more to the marital estate (the property subject to division), they may be entitled to a larger portion of the marital estate in order to achieve an "equitable" property distribution. Property division in Colorado does not have to be equal.

Assuming that you have been diligently paying the mortgage for 7 years and that you financed the home with a down payment - there is likely equity that is worth protecting. It is critically important to note that property distribution in Colorado is impacted by many of the facts and circumstances surrounding your life and marriage. I highly suggest that you have a consultation with an appropriate attorney licensed to practice law in Colorado.

I sincerely wish you only the absolute best that life has to offer and want you to know that there is light on the other side of all of this.

Q. Can I request food logs from my wife’s lawyer concerning my daughter’s metabolic disease PKU her levels continue to rise
A: You ask an excellent question!

To give you a direct response to the question of whether you can request food logs from your wife's attorney, yes, you are more than welcome to send opposing counsel a request for the logs. However, that does not necessarily mean that they have to respond or that they have to provide them. Generally, proper procedures have to be used within specific timeframes.

Your question really drives at the "information collection" stage of a case. This is commonly referred to as "discovery." Discovery can be a rather complicated and nuanced topic as there are several sets of laws at play (evidence, civil procedure, statute, case law, etc.) - especially when we start talking about medical records and attempting to prove that your child has a medical condition and that your wife has permitted the child's condition to worsen.

Given the degree of complexity, I highly suggest that you seek out and retain counsel to represent you through this case. I also understand that attorneys are very costly and are just out of the budget sometimes. I suggest that you contact Metro Volunteer Lawyers (a legal services organization in Denver, CO) to see if they are able to help you or point you in the direction of services that might be more appropriate. They can be contacted at: (303) 830-8210.

I sincerely wish you and yours only the absolute best.

Q. can I get my money back for a car that was always a gift?
A: Hi There,

I completely appreciate that domestic relations cases are complex and applying the law to a specific set of circumstances can be tricky - much of the reason that attorneys will specialize in a certain field of law (as opposed to practicing across many of them). I also understand that it can be difficult to know what exactly to communicate to get an answer to your question(s). Unfortunately, there is a bit too much missing information and context in your post to give you a meaningful and helpful response. I highly suggest that you schedule a consultation (many of them are free), to have an attorney qualified to practice law in Colorado review your case and give you better-tailored insight and direction.

I sincerely wish you only the absolute best!
