Biography

I have been practicing law for over 30 years. I have served as a legal services attorney representing clients in orders of protection, divorce, and parentage matters. Next I served as a public defender for 4 years, handling criminal law, juvenile law and mental health commitment cases. I have been in private practice on my own since 1999 representing people in a variety of cases, mostly family law, juvenile law, criminal law, domestic violence, guardianships, powers of attorney, wills and landlord-tenant cases. I do a smattering of other things in general. I also hold a Master's degree in Social Work, so I understand the mental health problems that are invariably involved in these matters.

Q. What are the requirements and responsibilities for short-term guardianship in Illinois?
A: You can use a form on the internet for this. Court is not necessary. Both mother and father should sign. Search for CFS 444-2 and you will find that form.

You will raise the child as yours for one year.

You are responsible for costs, including medical, educational, etc. that are incurred while the child is in your care unless the agreement says otherwise.
Q. Can DCFS continue drug tests after 6 clean months in IL?
A: When DCFS has your children or your boyfriend's children and you want them back, you do whatever they say whenever they say. A drug test is not unreasonable EVER when it comes to the safety of children. If doing drugs is more important than the children to the two of you, then by all means let people know that so the children can go to a drug free home. It will save the system a lot of time and money.
Q. Can my maintenance be decreased after a salary reduction due to a promotion?
A: I don't believe so. You knew your promotion would result in a salary cut. Given that, you could have chosen to refuse that offer of employment. When the decrease in income is voluntary, one cannot decrease the maintenance they are paying. I suspect the court would keep you obligations the same.

If you can get your other job back, you might consider doing so.
