Q. Can a tenant countersue in a small claims appeal for a case won in CA?
A: Hello,

That's a great question! In almost every legal matter, the answer initially is "it depends," as many legal issues are complex in nature. That said, in most cases (including small claims cases), a party cannot raise new issues on appeal. The way the judicial system sees it, if they had the chance to raise it, but decided not to, they cannot typically raise it later. On appeal, the tenant in most cases cannot raise new information.
