Q. If I am inventor on a patent owned by the corporation I work for and the patent gets licensed, am I entitled to paymnt?

A: You've asked an important question, that comes up often with employees, and the answer is somewhat complicated.

In their employment agreements, many employers these days require new employees to assign any and all rights to their new inventions to the company. They also typically require employees to identify their inventions preexisting the employer-employee relationship, to draw a boundary between what is the employee's versus what will belong to the company once the relationship commences. These requirements are especially true for tech company employees, where innovations are an important part of the company's business model.

If no such agreements are in place, you have to look at the applicable laws in the employment state, and sometimes in the employer's headquarters state or the employee's state. States typically have "shop rights" that provide rights, such as outright ownership or some kind of license to newly created inventions by employees to their employers, especially if the invention was created during work hours. An example may be a royalty-free, non-exclusive, irrevocable license to use the invention afforded to the company. It's all state-dependent.

Q. If a company is using a patent I am named as an inventor, can I receive compensation for its use?

A: If I understand you correctly, this is not a company that employed you or engaged you as a contractor, but instead a company that in its business, implemented a method that's covered by your patent or implemented a device (or system) that uses what's covered by your patent. There may be infringement in that case, but be careful and definitely talk with your legal counsel first. Remember that for direct infringement, everything used in at least one of your patent claims must be used by the infringing method/device in order to establish infringement. Also, be careful about reaching out to a company and making an accusation of infringement, because you may be creating a sufficient threat such that the company could sue you defensively, in what is called a declaratory judgment action. A: It sounds like an awful situation and that your daughter is having to deal with this situation. It's unlikely counsel will want to take the case on contingency unless if the device has caused serious injury, because the damages even for what you've mentioned aren't sufficient. Court cases are very expensive in terms of resources and cost, and counsel would be doing this work essentially free of charge unless and until there is a settlement, which the manufacturer realizes. I'm surprised the company wouldn't wish to provide a refund, especially these days, given the vast impact of social media. (As always, this is not legal advice.)
