Q. Is a durable power of attorney only effective when I'm incapacitated?

A: A durable power of attorney allows the agent to continue to act after the principal becomes incapacitated. To answer whether the durable power of attorney is effective immediately or upon incapacity (springing), one has to review what was drafted.
