Biography
Brian Leininger has been practicing DUI defense in Johnson County, Kansas and throughout Kansas since 2001. Prior to that he was the General Counsel for the Kansas Highway Patrol, Special Assistant Attorney General, and Assistant District Attorney in Wyandotte County. Brian is a certified practitioner of and instructor for the Standardized Field Sobriety Tests. He is the only lawyer in Kansas to have completed the training to be a Drug Recognition Expert. In addition to typical DUI cases Brian handles drug DUIs and DUI-related batteries and homicides.

- Q. Can I get a kansas drivers license if I have a dui in virginia?
- A: No. Kansas will see that you still have things to take care of in Virginia. They will not give you a license until those things are fixed.
- Q. DWI and DUI? Are they the same.
- A: Yes, they are the same. Different jurisdictions just have slightly different names for the same thing. I've even seen them call OUI or OMVI.
- Q. Can you be arrested weeks after refusing any testing for Dui in Kansas?
- A: Yes, it is pretty common for the charges to come later when the driver has gone to the hospital. Sometimes blood or urine is obtained at the hospital and sent to the lab for testing. In that case it can be months before the case is charged. Even if there is no blood or urine the officers can take time to complete their investigation and file charges later.
