Biography

I have been a criminal defense attorney and representing clients from arrest to trial for more than 6 years. I graduated from Auburn University with a major in journalism and minor in English and obtained my law degree from the University of Colorado. My prior career was a journalist and newspaper reporter, reporting on hard news, crime, and politics. I seek to tell my client's story to advocate their position, whether this is arguing before a judge or to a jury. Clients can expect an attorney who is committed and compassionate, and who believes in the rights guaranteed to all by the U.S. Constitution.

I have taken more than 40 trials to a jury trial, securing not guilty verdicts on everything from driving under the influence and domestic violence charges to felony sexual assault. A: Probation comes with a variety of conditions and these conditions can vary from person to person. However, a prohibition against committing a new criminal offense is usually a standard condition of probation. If it is proven that a person violated the terms of probation, this can open them up to additional sentencing for the charge they were on probation for, which could include additional jail time. The standard of proof at a a probation revocation hearing is not the same as trial - which requires beyond a reasonable doubt - as violations of probation must be proven by a preponderance of the evidence, a standard of proof which means the violation was more likely true than not. Q. Hello! I have a quick question, is it legal to own a sword in my home in Colorado Springs?
A: Ownership of a sword in your home is not specifically prohibited by any current law in the Colorado Revised Statutes. However, since a sword can be construed as a weapon or even a deadly weapon, there may be other situations that make ownership or possession of such an item illegal based off your criminal history, status, and its intended use.

For example, it is routinely a condition of pre-trial release and probation to not possess any weapons, firearms or knives - a sword would most likely be considered to be a knife as the Colorado Jury Instructions define a knife as "any dagger, dirk, knife, or stiletto with a blade over three and one-half inches in length, or any other dangerous instrument capable of inflicting cutting, stabbing, or tearing wounds, but does not include a hunting or fishing knife carried for sports use." This would be a case specific determination as to whether possessing a sword in your home is prohibited based off your unique circumstances. ... Read More

A: This depends on a variety of factors. All persons arrested on a misdemeanor in Georgia must be brought before a judge for a bail determination within 48 hours after a warrantless arrest or 72 hours after arrest on a warrant. There are situations in which bail may be revoked, such as a situations where it is proven that a defendant has violated the previously imposed bail conditions.

For the period until a trial is given, speedy trial rights do not begin until after an accusation is filed. The state has up to 2 years from the date of the alleged crime on a misdemeanor to file an accusation.
