Q. pour over will FL my dad passed in 2022. all assets or debt he owned my went back to my grandmother she passed in
A: It sounds like your father had a pour-over will in Florida, meaning his assets were likely transferred to a trust upon his death. Since your grandmother (the trustee or beneficiary) also passed away, the estate has become more complex, especially with businesses, property, and holding companies involved.

Key Issues to Consider:

1️⃣ Do You Need to Sign the Receipt, Release, and Refunding Agreement?

This document is typically used to settle distributions and release the executor (your uncle) from liability.

If you don’t sign, you retain your right to challenge or request an accounting.

If you do sign, you waive many rights, including contesting the administration or seeking further claims.

2️⃣ Has a Formal Probate Been Opened for Your Grandmother?

If yes, you may need to file a claim or objection if you have concerns.

If no, someone (likely the executor or another heir) must initiate probate.

3️⃣ What Should You File?

Petition for Formal Accounting – If you suspect mismanagement or haven’t seen financial records, you can request a full estate accounting.

Petition to Determine Beneficiary Rights – If you are unsure of your inheritance rights, this can clarify your legal standing.

Objection to the Release Agreement – If you don’t agree with how the estate is being handled, filing an objection ensures your concerns are addressed.

4️⃣ Statute of Limitations Warning

Florida law has strict deadlines for contesting estate matters.

If your grandmother passed more than a year ago, time may be running out.

It’s crucial to review Florida Probate Code § 733.710 regarding creditor and beneficiary deadlines.

Next Steps:

✔️ Consult a Florida probate attorney ASAP to ensure you don’t miss critical deadlines.

✔️ Request an accounting if you haven’t seen financial records.

✔️ Decide whether to contest any distributions before signing any waivers.

Q. How to find a form for petition to determine exempt property
A: To find a Petition to Determine Exempt Property form, follow these steps:

1. Check Your State’s Probate Court Website

Most states provide probate forms online. Search for:
Q. Can I keep homestead status (not exemption) on a property that was specifically given to me in a Will if I am a friend?
A: Great question! Here’s the breakdown:

Homestead Status vs. Exemption

Homestead Status refers to the legal characterization of the property as a homestead, offering certain protections.

Homestead Exemption offers tax benefits and protections from forced sale by creditors.

In Your Situation:

Since you received the property through a Will, and there are no surviving spouse or children, you won't get the homestead tax exemption benefits since you’re not a qualifying heir. However:

1. Homestead Status of the Property:

Yes, the property can retain its homestead status as long as it was the decedent's homestead and is devised to you specifically.

This status protects the property from being sold to satisfy creditor claims against the estate, except for secured creditors like mortgage holders.

2. Personal Representative (PR) and Attorney Fees:

PR and attorney fees are generally considered administrative expenses of the estate—not creditor claims.

However, if the property retains its homestead status, it may not be used to satisfy these expenses.

3. Practical Implications:

Since you’ve been living there since probate opened in December 2019 and have established it as your primary residence, this further solidifies its homestead status.

With no other debts or creditors, the property is likely protected from being sold to pay PR and attorney fees.

Bottom Line:

The homestead status protects the property from forced sale due to creditor claims, but PR and attorney fees may still be payable from other estate assets. However, if there are no other assets and the property retains its homestead status, it should remain protected.

It’s best to consult with a probate attorney to confirm this protection in your specific jurisdiction, as laws can vary.
