Attorney Ann Thayer practices primarily in the areas of DUI, criminal, and traffic defense. She also handles protective orders for both sides and expungements. She has a passion for defense of both juveniles and adults that find themselves in trouble. Ms. Thayer attended Roanoke College in Salem, Virginia where she obtained a bachelor's degree in Criminal Justice in 2000. Attending Widener School of Law in Harrisburg, PA, Ms. Thayer worked with the Prince William County Attorney’s Office and The Air Force Judge Advocate General (JAG) in Warner Robins, GA as an intern before obtaining her Juris Doctorate in 2004.
Ms. Thayer founded her own law firm The Law Office of Ann Thayer, PLLC on February 1, 2020. Ms. Thayer is a member of the Virginia State Bar and the Criminal Law Section of the Virginia State Bar, Fairfax County Bar Association and the Criminal Section in Fairfax, Virginia Association of Criminal Defense Lawyers, and the National College of DUI Defense. She is also a founding member of DUIDLA (Driving Under the Influence Defense Lawyers Association). She serves as co-chair on the Fairfax JDR Court Committee, and is a member of the Fairfax GDC and Circuit Court Committees as well as member of the Circuit Court Technology Subcommittee.
She handles cases in the Counties of Fairfax, Arlington, Loudoun, and Prince William as well as the Cities of Alexandria, Fairfax, Falls Church, Manassas and Manassas Park. She also handles Town of Vienna, Herndon, and Dumfries cases.

- Q. I had received reckless by speeding ticket. 98/70 This happened in VA. Is there a way I can push my court date up?
- A: You can file a motion to continue in advance of court date to ask for a later date or request a continuance in advance to clerk. Whether you have to appear in person or by phone or video for the request depends on what county the ticket is in and what their procedures are in that clerks office. If you cannot get a continuance in advance then when you go to court you can tell judge you need more time to hire an attorney and the judge will usually grant that request
- Q. Should I get a lawyer to recant a statement
- A: You shouldn't be messaging or posting on social media. Anything you say can be used against you. Contact a criminal defense attorney in the county where this happened asap and get a consult. If case is in Northern VA I offer a free phone or video consult and you can contact me.
- Q. Do I have a right to defend my property using deadly force?
- A: No. Property owners cannot resort to the use of deadly force to defend their property. This general rule is based on the principle that no property is worth more than a human life, even if the human life happens to belong to an intruder. A property owner may only use reasonable force to prevent someone from entering his or her property or removing something from his or her property. While the use of deadly force is not permitted, defending property by means that might otherwise constitute battery or other intentional torts is lawful if the means are a reasonable use of self-help (e.g., tackling a thief in your backyard or locking an intruder in the basement until the police arrive). In most states, however, a property owner’s use of deadly force is allowed if an intruder is a threat to the property owner’s safety or is committing a forcible felony.
