Biography

Andrew Hughes represents railroad workers and other tradespeople diagnosed with cancer and leukemia following exposures to toxins such as diesel exhaust, asbestos and benzene-containing products. Before starting Hughes Law Offices LLC, Andrew defended railroads and asbestos manufacturers in FELA and product liability cases. His prior defense work makes him uniquely qualified to bring railroad cancer, mesothelioma, and benzene product liability claims on behalf of his clients. In proving up his cases, Andrew consults with top experts in industrial hygiene, epidemiology and occupational medicine. These experts help establish links between exposures to herbicides, diesel exhaust, asbestos, benzene, welding fumes, creosote, lead paint, silica, secondhand smoke, and other toxins and resulting illnesses such as lung cancer, bladder cancer, acute myeloid leukemia and multiple myeloma.

Q. My Dad worked for the railroad and now has lung cancer. He worked around diesel exhaust. Can he sue the railroad?
A: Yes - if he was exposed to diesel exhaust at work he may very well have a case. Diesel Exhaust is now considered a carcinogen by the World Health Organization. He would need to bring his action under the Federal Employers Liability Act. If he rode on locomotives, the Locomotive Inspection Act and Code of Federal Regulations will come into play as well. These are complicated toxic tort claims however, so make sure that you retain counsel who is very familiar with both FELA law and toxic tort litigation. Multiple experts will need to be retained in order to prove up a claim like this. Best of luck to you.
