17 Questions Answered
Q. I have a personal injury lawsuit in. I asked my attorney for a $500 front money on my case to pay some bills.
A: First the Bar in Mississippi, does not allow for the advancing of funds. If you are not happy with your attorney, I recommend that you contact them and set an appointment with your lawyer and go over your issues with them. If they do not give you answers that provide you peace of mind you can indeed discharge them and find a different attorney. I am sorry that you are having these issues.
Q. Falling and shattering knee cap at a grocery store with no wet floor sign. How long will it take to win the lawsuit?
A: This is not an easy answer. HAs suit been filed, has there been discovery. There is no simple answer to how long a claim takes. It depends on the facts, the parties involved and the court in which the case is filed. What you need to do is to have your mother in law call her attorney and make an appointment to go meet with them and get a better run down of how the case is progressing and what status needs to be followed. That is the best way to get a timeline.
Q. How much will child support take out my personal injury settlement in Ms
A: The answer is depends. First, how much are you getting in the settlement and how much do you owe in support. Based on the basic law in Mississippi, the DHS will want to recover as much as possible. If the child support lien can be fully satisfied while you still make any recovery, they will request full reimbursement. IF they cannot collect full funds, then they will listen to a reduced amount. If you have an attorney you should speak to them directly and get them working on a possible reduction. The amount and reduction may also be impacted on if the support is actually owed in Mississippi or from another state.
