- Q. What form is needed for an emergency custody hearing in Georgia?
- A: First of all if you don't have an order giving you custody then a form for an emergency hearing is probably not what you need. If you were not married to the mother and haven't legitimized, then that's what you actually need to do. But speak with an attorney directly so you can explain what kind of custody you have, if any, and they can advise you as to what to do next.
- Q. Do I need to return to court in GA to stop child support for children over 18?
- A: If you have a garnishment a court order might be needed to stop the garnishment. If there's no garnishment, you can contact the Division of Child Support Services to start the process of getting the order terminated.
- Q. Is my husband required to support us during legal separation in Georgia?
- A: The only way you can make your spouse pay any of your household expenses or any expenses for that matter is for you to obtain a court order. In order to obtain that order you have to file for divorce and have your spouse properly served. Then you can ask the court to hear any temporary matters that need to be addressed prior to trial.
