Q. Should I confess or deny involvement after leaving accident scene?
A: If you left the scene without giving your name, contact info, or insurance info to the other drivers, or if you didn't contact the police if you were unable to give your info to the drivers, you could be charged with the crime of leaving the scene of an accident under California Vehicle Code section 20001 or Vehicle Code section 20002. This is true even if you were not fault at all in the accident. California law says that you must proivide your information either way. If there's bodily injury involved to other people, you could even be charged with a felony. They already know the car involved. Whether they can place you as the driver or not depends on how good the witness descriptions are of the driver, if they caught the drivers image on video, or other circumstancial evidence from before or after the crash.

At this point it would be wise for you to get legal representation. You'll definitley need counsel if charged with a crime, and even before that, it's very important to be represented, especially if investigators are trying to contact you. If your're going to make any further statements or are even thinking about doing so, it is very important to speak with an attorney and be properly advised before you make your next move.

Q. Warrant issued for burglary & theft with no court dates set in California.
A: It is common for the OC District Attorney to act in this fashion. Someone gets arrested or cited and released with an appearance date for court. The person shows up and chargers are not yet filed. Either the police havent's submitted the file to the DA on time or the assigned DA has not gotten around to reviewing it in time by the filing date. Then you are blindsided by the warrant. It's way more common than you would think. You need to have an attorney put it on calendar and then have a bail agent rady to post bail so you can get your warrant taken care of and go home that day. Then you will begin to handle your case in court with your attorney, out of custody, assuming bail is what it is and there are no surprises. ... Read More
