Biography

Mr. Green is General Counsel, P.C.'s founder, managing partner and leads its employment law practice.

Merritt serves as an outside general counsel to numerous clients providing guidance on legal issues confronting businesses and non-profit organizations ranging from contracts and agreements to the structuring of corporate transactions and business formations. Merritt also represents businesses and individuals in all aspects of labor and employment law.

Merritt received his J.D., cum laude, from the Syracuse University College of Law (1997). At Syracuse, he was an Associate Editor of the Syracuse Law Review and was Editor-in-Chief of The Labor Lawyer, the publication of the American Bar Association Labor and Employment Law Section. He was a College of Law Scholar and was inducted into the Justinian Honorary Law Society.

Merritt received his undergraduate degree from Middlebury College (1992) and spent a year as a student of Wadham College, Oxford University. Prior to opening General Counsel, P.C., Merritt was an associate with Venable LLP.

Q. Is time spent in a work mandated quarantine required due to work travel paid, or considered hours worked?
A: This is a complicated question because there are a number of variables. First, are you hourly or salaried employee. Next, could the leave qualify under the Families First Coronavirus Response Act (https://www.dol.gov/agencies/whd/pandemic/ffcra-employee-paid-leave). Third, are you doing any work during quarantine. Fourth, if quarantine is due to business required travel, could make argument that required quarantine also work related. Need to consider each of these factors. It is recommended that you speak with an attorney.
Q. Is it legal in virginia to have more then one worksheet to avoid paying overtime?
A: If you are working for the same employer, the Fair Labor Standards Act ("FLSA") requires that an employee is paid overtime for any hours over 40 in a week. Period. It does not matter if you work at more than one location. It same employer, must be paid overtime. Complication could be if each location is separate employing entity (separate payrolls, independent legal entities, etc.). But, that is beyond scope of this question. If that is case, contact an attorney.
Q. If I am fired for losing a part do I legally have to pay for the part replacement
A: Virginia wage law provides, in relevant part: "No employer shall withhold any part of the wages or salaries of any employee except for payroll, wage or withholding taxes or in accordance with law, without the written and signed authorization of the employee." So, if no written agreement, employer cannot reduce your wages.
