A: It depends on many factors, including whether he has a prior criminal record. It is up to the Ohio prosecutor's office to decide whether to pursue the case. While your lack of interest in pressing charges is a factor, they can still choose to pursue the case if they want to. With that said, it is obviously more difficult for them to pursue a case if you are not willing to assist them.
Q. My boyfriend was arrest on Saturday for AUO in the 2nd. While running his name, there was an outstanding warrant.
A: If he has a warrant in another country then he will have to go to the county and get the warrant cleared up or he runs the risk of getting rearrested
Q. Do I really need to sign up for DDP classes or can I just wait the three months when my license gets restored.
A: If you took a plea and part of that plea was and agreement that you do DDP classes, then I suggest you do those classes.
Q. how long in nys do you have to be arrained on a felony before its tossed out of court
A: I'm not sure I fully understand the question. An individual is supposed to be arraigned within 24 hours after arrest, but that doesn't mean the case will be thrown out if there is a delay. There are limits in the amount of time the prosecutor has to indict a case and bring the case to trial that would potentially cause a case to be dismissed.
Q. What happens if your on probation for domestic violence and you get charged with the same offense again
A: It depends on several factors. If you had an order of protection from the first offense, then potentially the new case is a violation of the order of protection so you could be facing contempt charges along with whatever new charges stem from the offense. A second offense of domestic violence is very serious and there is a possibility of jail time.
Q. My boyfriend was arrested early this morning and is being charged with felony domestic battery involving strangulation?
A: It would depend on several factors, including his prior criminal history and whether he has warranted in the past.
Q. I got charge for domestic violence misdemeanor ,I moved states before my court date wha's gonna happen?
A: You should contact an attorney in the state where the charge is pending and see if they can find out if there is in fact a warrant for your arrest. If there is, your best bet is to come back and deal with it. If you get stopped for even a traffic infraction, you could end up in jail due to this warrant.
Q. I'm 18, my girlfriend is 15 and her mom wants to put me in jail.. Can she do that?
A: If there is proof of a sexual relationship, then it is certainly possible for you to be prosecuted.
Q. I have 2 dwi charges am currently fighting will that affect my chances of beating them?
A: While each case is based on its own set of facts, it is possible in certain circumstances that the prosecutor could use evidence of one DWI to prove some of the elements of the second DWI.
